1. Acceptance of terms

These Terms of Service (“Terms”) govern your use of the website at ultimatemobilegaming.com and any events, services, or communications provided by Ultimate Mobile Gaming Franchise Group, LLC (“UMG,” “we,” “us”). By booking an event, using the site, or replying to our messages, you agree to these Terms.

2. About the company

Ultimate Mobile Gaming Franchise Group, LLC is a Georgia limited liability company doing business as Ultimate Mobile Gaming, serving the Atlanta metro area, Winder, and Northeast Georgia.

3. Bookings, deposits, and payment

• All bookings require a non-refundable deposit to hold your date.
• The remaining balance is due on the day of the event before service begins.
• Accepted payment methods include CashApp, Venmo, and major credit/debit cards. A $25 discount is available when the full balance is paid via CashApp or Venmo.
• Prices, availability, and package contents may change without notice; the price confirmed on your booking is what applies to your event.

4. Cancellation & rescheduling

• More than 14 days before the event: deposit is fully refundable.
• Within 14 days: deposit is credited toward a future booking.
• Within 48 hours: deposit is forfeited unless caused by severe weather, medical emergency, or other exception at our discretion.

5. Client responsibilities

• Provide accurate contact info and a valid event address.
• Ensure a safe, level setup area with reasonable access for our vehicle and equipment, and access to an appropriate power source when required.
• Provide adult supervision throughout the event.
• Inform us of any dangerous pets, wildlife, or hazards on the property.

6. Assumption of risk & liability waiver

Our activities (mobile gaming truck, laser tag, Nerf battles) involve ordinary physical activity, movement between play zones, use of tag/blaster equipment, and entry into a mobile trailer. By booking and by allowing guests to participate, you and each participant (or their parent/guardian) acknowledge and accept the inherent risks of active play, including but not limited to slips, trips, falls, collisions, and minor equipment-related injuries.

You agree to release, indemnify, and hold harmless Ultimate Mobile Gaming Franchise Group, LLC, its owners, employees, contractors, and agents from claims, damages, or losses arising from ordinary participation in the event, except to the extent caused by our gross negligence or willful misconduct.

7. Property, equipment, and cleanup

Guests must treat equipment (controllers, TVs, taggers, blasters, obstacles) with reasonable care. The booking party is responsible for the cost of repair or replacement of any equipment damaged through misuse, vandalism, food/drink spills, or reckless behavior during the event.

8. Photo & video release

Our crew may take photos and short video clips during your event. By default, UMG may use these on our website and social media to promote the business, with no names or personal details attached. If you would prefer we do not photograph your event or a specific guest, tell your crew on-site or email support@ultimatemobilegaming.com before the event.

9. Communications consent (AI voice, calls, SMS, email)

By booking or contacting us, you agree that we may reach you by phone, SMS, and email about your booking, including through automated AI voice calls and automated SMS. Transactional messages (confirmations, reminders, deposit links, weather updates) are sent to the number you provide. Marketing SMS require a separate opt-in.

10. Intellectual property

All content on this website — logos, artwork, photography, video, copy, and page design — is owned by or licensed to UMG and may not be copied, redistributed, or used commercially without written permission.

11. Third-party services

Some site features are provided by third parties (Google Calendar, Google Reviews, Instagram embeds, payment processors, AI voice/SMS platform). UMG is not responsible for the availability, terms, or privacy practices of those third parties. Their terms apply to their portions of the service.

12. Indemnification

You agree to indemnify and hold UMG harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of our services, or the conduct of guests at your event.

13. Limitation of liability

To the maximum extent permitted by law, UMG’s total liability for any claim arising from or related to your booking or use of the site is limited to the amount you paid to UMG for the event in question. UMG is not liable for indirect, incidental, special, consequential, or punitive damages.

14. Governing law & venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Subject to the arbitration clause below, exclusive venue for any legal action lies in the state and federal courts located in Barrow County, Georgia.

15. Dispute resolution & arbitration

You and UMG agree to first attempt to resolve any dispute informally by contacting support@ultimatemobilegaming.com. If we cannot resolve it within 30 days, any dispute arising out of or relating to these Terms or your event will be resolved by binding arbitration in the State of Georgia under the rules of the American Arbitration Association. Both parties waive the right to a jury trial and the right to participate in a class action. Small-claims-court disputes are excluded from this section.

16. Severability & entire agreement

If any part of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and SMS & Calling Consent page, are the entire agreement between you and UMG regarding the subject matter here.

17. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Continued use of the site or booking of events after changes take effect constitutes acceptance.
